Accuracy of Content, Prices, Product Descriptions and Images Policy

1. Purpose and Scope

This policy explains how ALEMÈ Health (Pty) Ltd (“ALEMÈ”, “we”, “us”) manages the accuracy of information displayed on www.aleme.co.za (“the Website”), including product descriptions, health content, images, stock availability and pricing. It must be read together with our General Terms and Conditions and applies to all users of the Website.

2. Accuracy of Content

We take reasonable care to ensure that all information displayed on the Website is accurate, complete and current.  Despite this, errors, omissions and outdated information may occur from time to time. Content is provided in good faith and, to the extent permitted by the Consumer Protection Act 68 of 2008 (“CPA”), we do not warrant that all content is free of errors.  Where we become aware of a material error, we will correct it as soon as reasonably possible.  Health-related content is provided for general information only and does not constitute medical advice.  Package inserts, professional information leaflets and the advice of your pharmacist or prescriber always take precedence over Website content.

3. Product Descriptions and Images

Product images are for illustrative purposes only. Actual products may differ from images shown as a result of manufacturer packaging changes, batch variations, screen colour settings or the substitution of an equivalent registered product.  Descriptions, ingredient lists and nutritional or pharmacological information are based on information supplied by manufacturers and may change without notice.  It is advised to always read the label, package insert and any accompanying documentation before using a product, and direct any queries to our pharmacists before use.

Compounded medicines are prepared individually for a specific patient according to the prescription.  Their appearance, form and packaging may differ from any generic depiction, and no image on the Website constitutes a representation of a compounded product’s final appearance.

4. Pricing

• All prices are quoted in South African Rand and, unless expressly stated otherwise, include Value-Added Tax at the prevailing rate.
• Medicines that are regulated under the Single Exit Price (“SEP”) framework in terms of the Medicines and Related Substances Act, 101 of 1965, are priced based on the applicable SEP together with the permitted dispensing fee prescribed by the Good Pharmacy Practice guidelines. The prices of these medicines may be amended whenever the Minister of Health adjusts the SEP, and any such price changes may take effect on the Website without prior notice.
• Quotations for compounded medicines are calculated per prescription based on ingredients, quantities and preparation required, and remain valid for [7] days unless otherwise stated.
• Delivery fees, where applicable, are displayed separately at checkout before you confirm your order.
• In the event of an obvious and material error in the pricing or product information displayed (including, but not limited to, a price that is clearly incorrect as a result of a typographical, technical, or data-feed error), we will not be obliged to honour the erroneous price. If an order is placed based on such an error, we will inform you as soon as reasonably practicable and provide you with the option either to proceed with the order at the correct price or to cancel the order and receive a full refund of any amounts already paid. This provision will be applied in a manner that is consistent with the Consumer Protection Act (“CPA”).

5. Promotions and Special Offers

Promotional prices apply only for the stated promotional period, while stocks last, and may be subject to additional conditions displayed with the promotion.  Promotions may not be exchanged for cash and may not run concurrently with other discounts unless expressly stated.  Scheduled medicines are advertised and promoted only to the extent permitted by the Medicines Act and its regulations; medicines in Schedule 2 and above are not advertised to the public and are not subject to public promotional discounting.

6. Stock Availability

All products are offered subject to availability. Display of a product on the Website is an invitation to do business and does not guarantee availability.  If a product or compounding ingredient becomes unavailable after you place an order, we will notify you and offer a suitable alternative (including, where lawful and clinically appropriate, a generically equivalent medicine in consultation with our pharmacist) or a full refund of the amount paid for the unavailable item.

7. Reporting Errors

If you identify an error on the Website, including an incorrect price, description or image, please notify us at info@aleme.co.za so that it can be investigated and corrected.
